AVC-PORTS-AB-00A — STATUTORY AND OPERATOR PORT CONTRACTOR APPLICABILITY MATRIX
WHEN THIS MATRIX IS REQUIRED
Use AB-00A before issuing a port contractor H&S file and whenever the project scope changes. It distinguishes actual South African legal obligations, port governance and operator permissions from AVC supporting records; not every listed law or restricted trade applies to every contract.
LEGAL AND AUTHORITY TOPICS PRINTED IN THE SOURCE
The matrix explicitly addresses the OHS Act 85 of 1993; conditional Construction Regulations 2014; National Ports Act 12 of 2005; Port Regulations and Port Rules; relevant Merchant Shipping and SAMSA framework; Commercial Diving Regulations 2022 where specialist diving is contracted; applicable electrical, driven machinery, pressure and chemical rules; environmental/waste obligations; controlled port, terminal and vessel access; and selected AC–AU trade records.
HOW TO USE THE ACTUAL FOUR-COLUMN MATRIX
For each row review REQUIREMENT, BASIS, FILE REF and CONTRACTOR RESPONSE / RESPONSIBLE PARTY. Record the real contract work class, legal applicability, responsible duty holder, operator document and related AVC evidence. A conditional rule cannot simply be ticked as always applicable. Obtain current port rules, Harbour Master or terminal requirements and competent legal/technical advice where warranted.
HOLD AND DIFFERENT AUTHORITIES
This matrix never replaces legislation, a diving permit or a Harbour Master, port, terminal or ship Master authorisation. Hold affected work until the actual duty owner and operator acceptance is documented. Retain all Section AB forms in the complete master and select AC–AU only for awarded trade scope.
