002 - AB-00A | Statutory, Operator & Contractor Duty Activation Matrix
When and why the statutory duty matrix is used
Distinguish legal obligations, the operating company’s controlled procedures and AVC supporting forms.
Original evidence matrix and law applicability
The original table has four explicit headings: REQUIREMENT, BASIS, FILE REF, CONTRACTOR / OPERATOR RESPONSE. It covers OHS Act 85/1993 / LEGISLATION; MHI Regulations 2022 and applicable 2026 phases / OPERATOR + APPLICABLE DUTIES; Hazardous Chemical Agents Regulations 2021 / WHERE TRIGGERED; Construction Regulations 2014 / CONDITIONAL; Pressure Equipment Regulations 2009 / CONDITIONAL; Electrical Machinery / Installation Regulations / CONDITIONAL; Host process risk, permit, isolation, gas testing / OPERATOR SITE REQUIREMENT. The relevant ACTUAL legislative duty, whether operator-owned or contractor-owned, is assessed only as applicable to the work, including conditional Construction Regulations and phased MHI duties—not automatically imposed on every contractor.
How to complete, review and keep evidence
Use the FILE REF column to identify the exact A–AA/AB supporting section, and the CONTRACTOR / OPERATOR RESPONSE column to record the facility-specific owner, actual technical evidence and open actions. Document legal and permit applicability with the operator and appointed competent reviewers before issuing the real workpack.
What this matrix does not authorise
This is an aid to identifying duties and records; it does not issue MHI accreditation, replace an establishment safety case/MIPP, or prove all laws are automatically applicable. Facility permits, risk assessments and statutory obligations remain separately controlled.
